If Injured By A Defective Product, Save The Evidence!

If you are injured as a result of a defective or dangerous product at home, at work or at a friend’s house, it is important to contact an attorney at our office immediately. Save all the evidence or materials you can pertaining to the product, because this can assist your attorney in making your potential case. Outlined below are some tips for saving evidence:

  • MOST IMPORTANTLY, do not discuss the case with anyone except an attorney. Do not give any written or recorded statements about the incident.
  • Save Evidence
    • Save and keep the product and all documents or packaging that accompanied it.
  • Take Photos
    • Take photographs of the product, injury site on the body and the location where the accident occurred (if applicable).
    • Take photographs of all the product documentation.
  • Record Information
    • Identify as much information about the product as possible, including the name of the manufacturer, the model name and number, place and date of purchase, and serial number.
    • Obtain the names, addresses and telephone numbers of any witnesses. If the incident happened at work, document the names and telephone numbers of co-workers.
    • If it is a prescription drug:
      • Obtain a copy of the prescription log showing refills from all pharmacies you had the prescription filled at.
      • Obtain a copy of your medical records regarding the drug from all prescribing and treating physicians, and your medical records from the hospital or clinic where your injury treatment was received.
  • Store Evidence
    • Store all documentation/packaging in a safe place and do not modify or change anything. If possible, box it all up and tape the box. Mark “Do Not Open” and place the current date on the box.
