What Determines A Product To Be Defective?

A defective product is one that is not reasonably safe for its intended use. These typically fall under three areas:

  • A design defect
    • Involves where the product was made and the way it was designed. There is a defect in the design that made it unsafe.
  • A manufacturing defect
    • The product is not made correctly, even though the design was okay, and it injures somebody.
  • Failure to warn or instruct
    • An appropriate warning was not on the product, or instructions on how to use the product were inadequate and it led to injury.
